By means of a fully completed application form sent to the KFPS ‘The organiser’, the applicant ‘stand holder’ declares their agreement with these terms and conditions.
From the application itself no right can be derived as to the allocation of stand space. In special cases the organiser has the right not to consider an application, allocate less stand space than requested, decide to change already allocated stand space, or withdraw allocation of stand space without entitlement on the part of the applicant to any compensation for damages. The details required on the application form have to be answered in full. The organiser has, without any obligation for compensation of damages, the right to refuse, as well as instantly remove from the event premises any goods and services not stated on the application form or which they consider to be inadmissible on the basis of the conditions of participation.
At all times the organisers retain the right in case of extraordinary circumstances (in case of force majeure) to change the date of the event or to cancel the event, without the stand holder being entitled to claim compensation for any losses. An application cannot be withdrawn or changed by unilateral decision of the stand holder. The organiser can approve a request for cancellation or change of the application subject to the condition that the participant in question pays the cancellation fee. In case stand holders are forced to cancel their stand, cancellation charges will be payable. The following charges will apply: until three months prior to the event 10% of the price of stand rent, until two months prior to the event 25% of the price of stand rent, less than two months prior to the event 40% of the price of stand rent and two weeks prior to the event the full amount of stand rent.
All prices mentioned are excluding VAT and excluding energy costs. Payment of stand rent is due prior to the start of the event. You will timely receive the invoice. In case of direct debit this is 5-8 days after the invoice date. In case the invoice has not been payed in advance, access to the event can be refused.
The stand holder keeps goods and properties at the event venue at his own risk and expense. Insurance thereof is not the responsibility of the organisers. The organisers cannot be held liable for damage of any sort inflicted on goods or people caused by or in connection with participating in the event, unless in cases of malicious intent or gross negligence on the part of the organiser. Security present at the premises are not responsible for your stand. Neither can the organiser be held liable for any damage to third parties caused by use of the stand by the participant or his staff. The participant indemnifies the organiser for any claims from third parties in this respect. The participant is liable for and obliged to take out adequate insurance against all damages caused in any way through the actions or negligence of himself, his staff, or persons who in any manner are employed by him or operate for him, as well as by his exhibits / goods. The participant indemnifies the organiser for all claims other parties could bring against the organiser.
The organiser has the right to enforce, without any notice of default or legal intervention and at the participant ́s expense, one or more of the following measures against any stand holder who acts contrary to the provisions of the conditions, or who does not observe instructions provided by or on behalf of the organiser, -refuse the person(s) concerned access to the event with immediate effect; – close down and/or evacuate his stand; -retain the exhibited goods as well as everything erected and installed; without the participant being able to claim any reimbursement or compensation for damages. If you have any complaint you are requested to hand this in without any delay and no later than 30 days after the last trading day. After this time frame complaints will no longer be dealt with.
